DECREE NO. 2005-145 OF MARCH 2, 2005 REGULATING TOURIST ACCOMMODATION ESTABLISHMENTS.
The President of the Republic, Having regard to the Constitution, in particular article 43; Having regard to law n° 94-69 of August 22, 1994 establishing the regime for the exercise of economic activities; Having regard to regulation C-REG-14/12/99 of December 7, 1999 adopting classification standards and conditions for the approval of tourist hotels, inns and motels; Vu l’ordonnance n° 91-41 du 3 septembre 1991 instituant la taxe parafiscale dénommée taxe de promotion touristique ; Vu le décret n° 92-736 du 4 mai 1992 fixant les modalités de gestion de la taxe de promotion touristique ; Vu le décret n° 2004-1211 du 6 septembre 2004 portant création et fixant les règles d’organisation et de fonctionnement de l’Agence nationale touristique ; Vu le décret n° 71-1172 du 2 novembre 1971 relatif au classement des hôtels ; Vu le décret n° 73-1107 du 11 décembre 1973 relatif au classement des restaurants de tourisme ; Vu le décret n° 2004-103 du 6 février 2004 portant organisation du Ministère du Tourisme ; Vu le décret n° 2004-579 du 30 avril 2004 relatif aux attributions du Ministre du Tourisme et des Transports aériens ; In view of decree no. 2004-1406 of November 4, 2004 on the distribution of State services and control of public establishments, national companies and companies with public shareholding, between the Presidency of the Republic, the Prime Minister’s Office and the ministries, as amended;
DECREES:
Chapter II. – Approval of tourist accommodation establishments.
Art. 5. – Any individual or legal entity intending to develop a tourist accommodation facility is required to submit an application for approval to the Minister of Tourism, together with technical and financial documentation.
Art. 6. – The technical and financial file includes the following documents:
1. a request addressed to the Minister of Tourism indicating :

- the sign, address and exact location of the establishment
- the full name and address of the business owner
- surname, first name and address of the operator or person in charge of the establishment
- the establishment’s legal form.
2. a three-year operating budget;
3. a classification application including :
- a detailed plan of the proposed facility in compliance with the classification standards established by current laws and regulations;
- a description of the services to be provided, specifying the accommodation and/or catering capacity of the establishment and any ancillary activities.
Art. 7. – Approval is granted by order of the Minister of Tourism, after consulting the national commission for the approval and classification of tourist accommodation establishments. However, temporary authorizations may be granted to promoters to enable them to draw up their project and obtain approval. These authorizations may not exceed six months. Approval does not exempt beneficiaries from the authorizations and certificates required by the laws and regulations in force, in particular authorization to set up a business, registration in the Trade and Personal Property Credit Register, building permits, and compliance with architectural, town-planning, health and safety standards.
Art. 8. – The concession or rental of state-owned land for tourism purposes may only be granted to operators who have been approved by the Minister of Tourism.
